Email was the "smoking gun" in four of the top ten verdicts in 2005, reported Lawyers USA. They specifically reported:
"This was also a year when e-mail showed itself, once again, to be a rich source of "smoking gun" evidence. E-mail played a crucial role in four of the Top Ten verdicts of 2005, including the #1 investment verdict, the #3 Vioxx verdict, the #6 verdict involving an events promoter and the #9 age discrimination verdict involving the private pilot for Bruce Willis and Demi Moore.
The promoter's attorney, Jeffrey Singer, noted that his case is yet another example of how e-mails can provide crushing evidence against corporate defendants.
"It can be very damaging because people can be much more candid in e-mails than they might be in formal letters," he said.
